Release of Liability, Waiver of Claims, Assumption of Risks, Indemnity, Medical Authorization & Media Consent
This agreement contains important legal terms regarding risk and liability. By signing, you confirm that you understand and accept these terms.
1. Parties & Definitions
“Footwork Lab” includes its owners, directors, officers, employees, contractors, volunteers, agents, sponsors, partnering facilities, and landlords (collectively, the “Releasees”). “Participant” means the adult registrant or the minor child named on the corresponding online Intake form. “Parent/Guardian” means the person with legal authority to sign for a minor.
2. Fitness to Participate & Duty of Disclosure
I certify the Participant is physically fit to take part in athletic training and related activities. I have disclosed all relevant medical conditions, allergies, medications, and restrictions, and will promptly update Footwork Lab if anything changes.
3. Assumption of Risks
Participation in athletic training involves inherent and foreseeable risks, including but not limited to: slips, falls, collisions, overexertion, strains/sprains, musculoskeletal injury, concussion, cardiac events, equipment/facility defects or misuse, weather/environmental conditions, and infectious disease exposure. I voluntarily assume all such risks, both known and unknown, including those arising from the ordinary negligence of the Releasees, other participants, or third parties.
4. Release, Waiver & Covenant Not to Sue
To the fullest extent permitted by law, I, for myself and/or the minor Participant, and our heirs, executors, and assigns, hereby waive, release, and forever discharge the Releasees from any and all claims for injury, disability, death, or property damage arising from or related to participation, including claims arising from the ordinary negligence of the Releasees. I further agree not to commence or join any action or proceeding against the Releasees in respect of such claims (covenant not to sue).
5. Indemnity & Hold Harmless
I agree to defend, indemnify, and hold harmless the Releasees from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including legal fees on a solicitor-client basis) brought by or on behalf of the Participant or any third party and arising out of or related to participation, except where caused by the Releasees’ gross negligence or willful misconduct.
6. Medical Authorization & Financial Responsibility
If illness or injury occurs, I authorize Footwork Lab to administer first aid, contact EMS, and secure medical or dental treatment deemed necessary. No guarantees are made as to treatment outcomes. I accept full financial responsibility for all costs associated with such care.
7. Rules, Removal & Conduct
The Participant must follow all rules, instructions, and safety protocols. Footwork Lab reserves the right to remove any participant for unsafe conduct or non-compliance, without refund.
8. Personal Property
Footwork Lab is not responsible for loss, theft, or damage to personal property.
9. Media Consent
Footwork Lab may capture photographs, audio, or video recordings during programs. These may be used for: Internal Use Only (training, safety documentation, staff education); Full Use (lawful promotional/marketing including website, print, and social media); No Consent (Footwork Lab will use reasonable efforts to exclude the Participant from future media capture/selection). I waive any right to compensation, royalties, or approval related to such use.
10. Privacy
Personal information is collected for safety, administration, and communication in accordance with applicable privacy laws.
11. Governing Law
This Agreement is governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. The parties submit to the jurisdiction of Alberta courts.
12. Severability & Entire Agreement
If any provision is held invalid, the remainder remains enforceable. This Agreement constitutes the entire understanding with respect to its subject matter.
